These Terms of Service (“Terms”) govern your access to and use of The Trades Board website (the “Website”), including all associated content, services, and features (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service.

1. About The Trades Board

The Trades Board is a job board website designed to connect skilled trades workers (“Tradespeople”) with employers (“Employers”) seeking their expertise. We aim to provide a platform that values the unique skills and experience of trades professionals.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this eligibility requirement.

3. Accounts

Registration: To access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for safeguarding your account password and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

Account Termination: We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

4. Content and Conduct

User Content: You are solely responsible for any content you post, upload, share, or otherwise make available through the Services (“User Content”). You represent and warrant that you have all necessary rights to User Content and that it does not violate any third-party rights.

Prohibited Conduct: You agree not to:

• Use the Services for any illegal or unauthorized purpose
• Post any content that is offensive, discriminatory, or violates any applicable laws
• Attempt to gain unauthorized access to the Services or other users’ accounts
• Use any automated means to access or use the Services
• Interfere with or disrupt the Services or servers

Our Rights: We reserve the right to remove or modify any User Content that violates these Terms.

5. Job Postings and Applications

Employer Responsibilities: Employers are responsible for the accuracy and legality of their job postings.

Tradesperson Responsibilities: Tradespeople are responsible for the accuracy of their resumes and applications.

No Guarantee: We do not guarantee that Employers will find suitable candidates or that Tradespeople will find employment through the Services.

Third-Party Job Listings:

Disclaimer: Job listings on The Trades Board are sourced from publicly available job postings and third-party sources. Information is provided for reference only and may change or be removed by the employer at any time. The Trades Board does not guarantee the accuracy, completeness, or current availability of any job listing.

The Trades Board is not the employer for jobs posted on this site and is not responsible for:

• The content or accuracy of job postings
• Employment decisions made by employers
• Compensation, benefits, or working conditions
• Any disputes between employers and job applicants
• Verification of employer credentials or legitimacy

Users should independently verify all job details directly with the employer before applying or accepting any position.

Employer Pricing & Refunds:

Pricing:

• Job postings: $299 per 30-day listing
• Free trials: 30 days (no credit card required)
• Payment due at time of posting (after free trial expires)

Refund Policy:

• Free trials: No refunds (service is free)
• Paid postings: Refunds available within first 7 days if job receives zero qualified applications
• After 7 days: No refunds, but unused time may be credited toward future postings at our discretion
• Refunds processed within 10 business days

Cancellation:

• You may cancel your job posting at any time
• No refunds for partial months
• Cancelled postings are removed within 24 hours

Auto-Renewal:

• Job postings DO NOT auto-renew
• You must manually renew each posting after 30 days
• We will send reminder emails 7 days before expiration

Job Seeker Data Collection:

When Tradespeople create profiles or apply to jobs, we collect:

• Contact information (name, email, phone)
• Work history and experience
• Skills and certifications
• Resume/CV documents
• Geographic location

How We Use This Data:

• To match Tradespeople with relevant job postings
• To send job alerts and notifications
• To improve our matching algorithms
• To communicate with you about our services

We will NEVER:

• Sell your personal information to third parties
• Share your resume with employers without your consent
• Use your data for purposes other than job matching

6. Intellectual Property

Our Content: The Services and all content included on the Services, such as text, graphics, logos, images, and software, are the property of The Trades Board or its licensors and are protected by intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

7. Disclaimer of Warranties

The Services are provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall The Trades Board be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, damages for loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Services.

9. Indemnification

You agree to indemnify and hold harmless The Trades Board and its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Services or your violation of these Terms.

10. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will post any changes on the Website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association’s rules, rather than in court. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: You may bring claims in small claims court if they qualify, and either party may seek injunctive relief in court if necessary.

13. Email Communications

Unsubscribe: If you receive marketing or promotional emails from us, you may unsubscribe at any time by clicking the “unsubscribe” link at the bottom of the email or by contacting us at hello@thetradesboard.com.

Email Types:

• Transactional emails (account notifications, password resets) cannot be unsubscribed from
• Marketing emails can be unsubscribed from at any time
• We will process unsubscribe requests within 10 business days

We will never:

• Sell or rent your email address to third parties
• Send you emails after you’ve unsubscribed
• Use deceptive subject lines or headers

14. Force Majeure

The Trades Board shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
